Terms of Use

These Terms of Use govern access to and use of the Portal. Access implies unreserved acceptance of these Terms of Use. The User is solely responsible for the use that may be made of the Portal and for all content that he or she reproduces from or through the Portal and for any consequences that may arise from this. The User undertakes to use this Portal, its contents and services in accordance with the Law, these Terms of Use, morality and public order. Likewise, the user agrees not to introduce programs, viruses, macros, applets, ActiveX controls or any other logical device or sequence of characters that cause or risk causing any type of alteration in the computer systems of FLUIDRA ITALIA or third parties. Documents and graphics published on this server may include technical inaccuracies and typographical errors. Changes are periodically added to the information available. FLUIDRA ITALIA and/or its respective supplier may make improvements and/or changes in the program at any time. FLUIDRA ITALIA reserves the right to disable or block your access to the Portal if you violate these Terms of Use, third party rights or applicable legislation. FLUIDRA ITALIA is not responsible for any security errors that may occur, nor for any damage that may be caused to the User's device (hardware and software) and to the files or documents stored in it, as a result of the presence of viruses in the User's device used to connect to the services and contents of the Portal, an Internet malfunction, telephone failures, interference, omissions or disconnections in the operational functioning of the Portal caused by events that are beyond the control of FLUIDRA ITALIA.

Portal licence

FLUIDRA ITALIA is the owner and holder of all rights to the Portal and, as such, grants the User a free license to use the content and functionalities available on the Portal according to the uses for which it was designed and, in particular, in accordance with the provisions of these Terms of Use and/or applicable law. The licence to use the Portal is limited to the European territorial scope, therefore, although the User may access the Portal from outside Europe, its use is only authorised within Europe.

Intellectual and Industrial Property

All intellectual and industrial property rights to information, data, graphics, design, software, trademarks and other contents of the Portal (hereinafter referred to as "Intellectual Property Rights") are the property of the Fluidra Group and/or its licensors, hence it follows that it is forbidden for the user to use, reproduce, transmit, transform, distribute or exploit in any way whatsoever, except when it is part of the service integrated in the portal and for exclusively private purposes. Failure to comply may give rise to any legal or extrajudicial action aimed at exercising one's rights.

FLUIDRA ITALIA prohibits any action contrary to the regulations in force on the documentation or content that can be downloaded from the Portal. In particular, it is not permitted to manipulate or make any use other than that indicated for the contents, including product catalogues, price catalogues, etc.

Similarly, the trademarks or trade dress of FLUIDRA ITALIA or any other company belonging to the Fluidra Group may not be used in connection with any product or service that does not belong to the Fluidra Group or in any manner that is likely to cause confusion among Users or that may discredit FLUIDRA ITALIA or the Fluidra Group.

Jurisdiction and applicable law

The law applicable to these Terms of Use is the Italian law. In the event of any discrepancy or conflict, both parties shall submit to the Court of Brescia.
